The first “Criminal Law Forum” of Shanghai University of Political Science and Law was held in Shanghai on November 25, 2018. The forum, which took “the criminal law regulation of AI and related legal issues” as its theme, was attended by over 100 experts, scholars, judicial officials and law school students throughout the country, including professor Chen Zexian, a research fellow and the former director of CASS Institute of International Lawand executive vice president of the Criminal Law Research Committee of China Law Society. In a keynote speech given at the forum, Professor Chen Zexian pointed out that, the study of AI from the criminal law perspective should answer such questions as whether AI can become the subject of crime and bear corresponding criminal responsibilities, whether AI can become an instrument or object of crime, the development of the potential of AI, and legal liabilities of those who develop or control AI. Faced with breakthroughs in the development of AI technologies, all the legal professionals can do is to formulate “Achilles heel” provisions and require scientists and technical personnel to ensure the safe development of AI in the future.
