2018 Social Sciences Forum: The International Seminar on “Institutional Reform and the Rule of Law” was held in Beijing on November 16-17, 2018. The seminar, sponsored by CASS and organized by CASS Law Institute, was attended by over 60 sixty scholars and experts from universities, research institutions and government organs from ten different countries, including CASS Law Institute, Tsinghua University, Peking University, Judicial Research Institute of the Chinese Ministry of Justice, the Institute of Legislation and Comparative Law under the Government of Russian Federation, University of Helsinki (Finland), Soongsil University (South Korea), Yeungnam University (South Korea), National Autonomous University of Mexico, Trento University (Italy), Jagiellonian University (Poland), National University of Public Service (Hungary),University of Minster (Germany), Warsaw University (Poland), University of Maranion (Brizil) and Waseda University (Japan).

At the opening ceremony, presided over by Professor Mo Jihong, Deputy Director of CASS Law Institute, Professor Talia Khabliyava, Director of the Institute of Legislation and Comparative Law under the Government of Russian Federation, Professor Kimmo Nuotio, Chairman of the Council of the Finnish Center for Chinese Law Studies of University of Helsinki, and Professor Chen Su, Director of CASS Law Institute, each gave a speech, in which they stressed the importance of the discussion of the concept and principles of the rule of law and hoped that the forum would be able to help scholars from different countries to share their experiences of the construction of the rule of law.

 

 

The seminar was divided into four units. In the first unit “new development of the rule of law”, the participants gave keynote speeches and carried out discussions on such topics as constitutional review: a milestone in the development of the rule of law in China; the theory of the rule of law and the implementation of modern constitutions; the Finnish experience of the rule of law; the jurisprudential basis of constitutional review; main challenges faced by the rule of law in the 21st century; and the relationship between the rule of law and globalization.

  

  

In the second unit, “rule of law and the constitution”, the following topics were discussed: transitional societies and the revision of the constitution; the practice of the constitutional court in South Korea; the improvement of the administrative legal system in China; and the presidential supervision system in South Korea.

  

  

In the third unit, “the rule of law and social law”, the following topics were discussed: different approaches to the rule of law; improvement of the legal system of social security; challenges to the rule of law in a time of globalization, digitization, and immigration; brining the resolution of labor disputes under the rule of law; and the protection of non-regular employment and the rule of law.

 

 

  

In the fourth unit, “the rule of law and the improvement of legislation”, the participants discussed the following topics: the new legal framework of data protection in Brazil; the myth of justifiable defense and its solution; legal reform and the adaptability of law; pluralist dispute resolution mechanism and the rule of law; legislative reform and the construction of the legal system;and the rule of law and anti-corruption.
